TERMS & CONDITIONS
These terms govern your use of the AXARA applications. Please read them before subscribing.
WHO YOU ARE CONTRACTING WITH
The AXARA platform and its applications (AXARA LAND, AXARA FARM, AXARA INFRASTRUCTURE and the shared intelligence services) are supplied by Home Glazing Ltd ("we", "us"). AXARA Intelligence is a trading name of Home Glazing Ltd, registered in England and Wales under company number 16603440. AXARA Intelligence is not itself a separately incorporated company.
Registered and business address: 3 Cobble Courtyard, Penrith, United Kingdom, CA10 1DA. VAT registration number: GB505544212. By subscribing to or using the service you are entering into an agreement with Home Glazing Ltd.
ACCEPTANCE
By creating an account, accessing the platform, or continuing to use any part of the service, you agree to these terms. If you are using AXARA on behalf of an organisation, you confirm you have authority to bind that organisation. If you are using AXARA as an individual, you confirm you are of legal age to enter into a contract.
WHAT AXARA PROVIDES
AXARA is a physical intelligence platform. It retrieves, organises and explains evidence about places from public and licensed datasets, and records what it knows, what it has observed, and what remains unknown.
AXARA does not provide planning permission, valuation, legal advice, surveying advice, structural or engineering conclusions, or professional due diligence. Outputs are decision support and must be verified against authoritative sources and by appropriately qualified professionals before any decision is taken. Coverage of underlying datasets is partial, and the absence of a record is not evidence of absence.
YOUR ACCOUNT
You must provide accurate account and organisation information and keep it up to date. You are responsible for keeping your credentials confidential and for all activity that takes place under your account. Tell us promptly if you believe your account has been compromised.
LICENCE AND RESTRICTIONS
We grant you a limited, non-exclusive, non-transferable right to use the service within the plan and seat allowance you have purchased, for your own business purposes.
You must not:
- reverse engineer, decompile or attempt to derive the source of the platform;
- resell, sublicense or redistribute the service or its outputs as a competing product;
- circumvent seat limits, entitlement checks, rate limits or other technical controls;
- use the service to build a substantially similar service.
ACCEPTABLE USE
You must not misuse the service. In particular, you must not:
- use AXARA for any unlawful purpose, or in breach of dataset licence terms;
- use it for fraud, spam, harassment or surveillance of individuals;
- infringe the intellectual property or privacy rights of others;
- interfere with the security or integrity of the platform, including introducing malware, probing, penetration testing without written consent, or scraping.
AI-ASSISTED OUTPUTS
Parts of AXARA — including Ask AXARA, briefings and written interpretation — are produced with the assistance of AI models grounded in the evidence AXARA holds. These outputs may be incomplete or inaccurate. They are not suitable for regulated professional advice without human oversight, and AXARA will refuse to produce conclusions it cannot support with evidence (for example structural safety, remaining asset life, or planning permission likelihood).
You are responsible for the questions you ask, for having the rights to any content you upload, and for verifying any output before relying on it. We may filter or refuse outputs, remove content, and restrict or suspend accounts where content or use breaches these terms. If you believe content on the platform infringes your rights, contact us and we will review and, where appropriate, remove it; repeat infringement will result in termination.
YOUR CONTENT
You keep ownership of the site boundaries, documents, observations and other content you add. You grant us a limited licence to host, process and display that content solely to provide the service to you and your organisation.
OUR INTELLECTUAL PROPERTY
We retain all rights in the AXARA platform, including its software, evidence architecture, documentation, methodology and branding. Nothing in these terms transfers any of that to you. Third-party datasets remain subject to their own licences, which AXARA records alongside the evidence it presents.
SERVICE LEVEL
We work to keep AXARA available and accurate, but we do not guarantee uninterrupted or error-free performance. AXARA depends on third-party data sources that may be unavailable, delayed or withdrawn; where that happens AXARA reports the gap rather than filling it.
PAYMENT AND SUBSCRIPTION TERMS
Subscriptions are billed in advance on the interval you select, in pounds sterling plus any applicable VAT. Plans renew automatically until cancelled.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms. See also our Refund Policy.
SUSPENSION AND TERMINATION
You may cancel at any time; access continues to the end of the paid period. We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. Where the breach is capable of remedy we will normally give you notice and an opportunity to fix it first.
On termination you may export your records for 30 days, after which we may delete or anonymise your data in line with our Privacy Notice.
WARRANTIES AND LIABILITY
To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
We are not liable for indirect, consequential or special loss, including loss of profit, data, opportunity or goodwill. Our aggregate liability is limited to the fees you paid in the twelve months before the claim. Nothing in these terms limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be limited by law.
You indemnify us against claims arising from your content, your unlawful use of the service, or your breach of these terms.
GENERAL
You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. Neither party is liable for delay caused by events beyond its reasonable control. If any clause is unenforceable the rest continues to apply.
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
